Welcome to Jammbak Marketplace. These Terms of Use ("Terms") govern your use of jammbak.ae and related services provided by Jammbak General Trading LLC.

By accessing or using our Site, you agree to be bound by these Terms in accordance with Federal Law No. 15/2020 on Consumer Protection and Federal Decree-Law No. 14/2023 on Trading by Modern Technological Means. 

 1. Eligibility

By using this Site, you represent that:

• You are at least 18 years of age.
• You have full legal capacity to enter into this agreement.
• You are accessing the Site from a jurisdiction where our services are permitted.
• You will not use the Site for any illegal purpose.

 2. Account Registration and Security

• Accuracy: You must provide accurate and complete information.
• Responsibility: You are solely responsible for account activity.
• Security: Notify us immediately of unauthorized access.
• No Sharing: You may not share account credentials.

We reserve the right to suspend or terminate accounts for violations.

 3. License to Use the Site

We grant a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes.

You may not:

• Republish or commercially exploit Site content without consent
• Modify or create derivative works
• Use data mining or extraction tools

 4. User Conduct and Acceptable Use Policy

In compliance with UAE laws and cultural values, you agree NOT to:

• Harass: Abuse, defame, or threaten any user, vendor, or employee
• Illegal Activity: Violate any UAE laws or regulations
• Impersonate: Misrepresent your identity or affiliation
• Spam: Transmit unsolicited advertisements
• Interfere: Disrupt Site operations or networks
• False Information: Post misleading information about products or sellers

Violation may result in immediate termination and legal action.

 5. Intellectual Property Rights

5.1 Our Content

All Jammbak Content is protected by UAE and international intellectual property laws.

5.2 User-Generated Content

By posting reviews or comments, you grant Jammbak a license to use, reproduce, and display such content to promote and improve our services.

5.3 Vendor Content

Vendors retain ownership of their content but grant Jammbak a license to display it on the Site.

 6. Third-Party Links and Sellers

6.1 External Links

We are not responsible for third-party websites' content or practices.

6.2 Third-Party Sellers

As a marketplace, Jammbak does not endorse sellers or guarantee their products. Transactions are at your own risk, though we facilitate dispute resolution as required by Article 11 of Federal Law No. 15/2020. 

 7. Termination

We may terminate or suspend accounts without prior notice for Terms violations. Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination.

 8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant uninterrupted, secure, or error-free operation.

 9. Limitation of Liability

To the maximum extent permitted by UAE law, Jammbak shall not be liable for indirect, incidental, or consequential damages arising from Site use.

 10. Indemnification

You agree to indemnify Jammbak from claims arising from your Terms violations or violations of third-party rights.

 11. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the United Arab Emirates. 

Dispute Resolution:

1. Informal Negotiation: Parties shall first attempt informal resolution.
2. Dispute Resolution Committee: If unresolved, disputes may be referred to the Ministry of Economy's Dispute Resolution Committee as provided under Article 9 of Federal Decree-Law No. 14/2023. 
3. Arbitration: For disputes over AED 50,000, arbitration may be pursued if agreed upon. For disputes under AED 50,000, arbitration clauses are not permissible under UAE law. 
4. Jurisdiction: Otherwise, disputes shall be submitted to the courts of Dubai, UAE.

 12. Severability

If any provision is held unenforceable, remaining provisions continue in full force.

 13. Entire Agreement

These Terms, together with our Privacy Policy, Terms of Sale, and other legal notices, constitute the entire agreement.
